Terms of Service

1. Who we are

Creslo is provided by Creslo AI Ltd, registered in England and Wales (company number 17256802), with its registered office at Bartle House, Oxford Court, Manchester M2 3WQ. In these terms, "we", "us" and "Creslo" mean Creslo AI Ltd, and "you" means the person or business using the service.

2. The service

Creslo is a tool that helps you create social media content using AI, organise it around your brand, and schedule and publish it to social networks you connect. AI-generated output is a starting point: you are responsible for reviewing content before it is published.

3. Eligibility and accounts

You must be at least 18 and, if you use Creslo on behalf of a business, have authority to bind that business to these terms. You are responsible for keeping your login details secure and for all activity under your account. Tell us promptly at privacy@creslo.ai if you suspect unauthorised use.

4. Plans, trials and billing

Creslo offers a free tier and paid subscription tiers. Paid tiers may include a free trial (currently 14 days, or 30 days for our first 100 sign-ups). Trial terms are shown at sign-up.

• If you add payment details, your subscription begins at the end of the trial and renews automatically each billing period until cancelled.
• If you do not add payment details by the end of a trial, your account moves to the free tier.
• Payments are processed by Stripe. Fees are stated at the point of purchase and are exclusive of any taxes that may apply.
• You can cancel at any time; cancellation takes effect at the end of your current billing period. Except where required by law, fees already paid are non-refundable.
• We may change our prices or plans, giving you reasonable notice before any change affects you.

5. Your content

You keep ownership of the brand information, text, images and other materials you provide or generate ("your content"). You grant us a limited licence to host, process and transmit your content as needed to operate the service - including sending it to our AI and publishing providers and posting it to the accounts you have connected.

You are responsible for your content and for ensuring it is accurate, lawful, and does not infringe anyone's rights. Because content is generated with AI, you should review it before publishing - we do not guarantee that AI output is accurate, original, or suitable for a given purpose.

6. Acceptable use

You agree not to use Creslo to:

• create or publish content that is unlawful, defamatory, hateful, deceptive, or infringes intellectual property or privacy rights;
• send spam or violate the terms, rules or rate limits of any connected social network;
• impersonate others or misrepresent your connection to a person or organisation;
• attempt to disrupt, reverse engineer, or gain unauthorised access to the service; or
• use the service in a way that breaches applicable law or these terms.

You are responsible for complying with the terms and policies of each social network you connect and publish to.

7. Connected platforms and third parties

Connecting a social account is handled through our partner Zernio, and your use of each network remains subject to that network's own terms. We are not responsible for the availability, behaviour, or policy changes of third-party platforms, or for any action a platform takes against your account. AI, image, payment and email features rely on third-party providers listed in our Privacy Policy.

8. Our intellectual property

The Creslo software, branding, and design are owned by Creslo AI Ltd and protected by law. These terms do not transfer any of our intellectual property to you beyond the right to use the service as intended.

9. Availability

We work to keep Creslo running reliably but do not guarantee uninterrupted or error-free service. We may update, suspend, or discontinue features, and may carry out maintenance that temporarily affects availability.

10. Disclaimers

The service is provided "as is" and "as available". To the extent permitted by law, we exclude all implied warranties. We do not warrant that AI-generated content will be accurate, non-infringing, or fit for any particular purpose, or that publishing through connected platforms will always succeed.

11. Limitation of liability

Nothing in these terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or for fraud). Subject to that, we are not liable for indirect or consequential loss, loss of profit, revenue, data, or goodwill, and our total liability to you in any 12-month period is limited to the amount you paid us for the service in that period.

12. Indemnity

You agree to indemnify us against claims, losses and reasonable costs arising from your content, your use of the service, or your breach of these terms or of a connected platform's terms.

13. Termination

You can stop using Creslo and close your account at any time. We may suspend or terminate your access if you breach these terms or use the service in a way that risks harm to us, other users, or third parties. On termination, the licences you granted us end, except where we must retain certain records by law.

14. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, subject to any non-waivable rights you have as a consumer.

15. Changes

We may update these terms from time to time. If we make material changes we will update the date above and, where appropriate, notify you. Continuing to use Creslo after a change means you accept the updated terms.
